Richard D. Fincher, JD
Managing Partner

As a full-time mediator and arbitrator, Dick serves on the Commercial, Mass Claims, and Employment Panels of the American Arbitration Association. He is also a Labor Arbitrator on the panel of the American Arbitration Association, the Federal Mediation and Conciliation Service, and the National Mediation Board. The scope of his caseload includes disputes involving insurance, construction, probate, real estate, personal injury, consumer fraud, partnerships, and an array of employment discrimination and whistleblower claims.


Dick has a growing practice in the resolution of class action/mass claim litigation. He has served as a mediator and arbitrator in the Prudential Life Insurance litigation, which had 65,000 claimants and a $2.5 billion settlement. He was selected as an evidentiary consultant for the Merrill Lynch gender class litigation, and has lectured on the use of Special Masters and Consent Decree Monitors in employment litigation.

Prior to establishing his neutral practice, Dick served as a senior executive in law and human resources with three Fortune 500 corporations. He worked for five years with the American Arbitration Association in Washington, D.C., and served as an employment attorney and Corporate Labor Counsel with a major healthcare corporation. He currently teaches ADR and law while on the faculty of the Arizona State University.

Dick received his undergraduate degree in industrial and labor relations from Cornell University in Ithaca, New York and his law degree from the DePaul University College of Law in Chicago, Illinois.


Rocco Scanza, JD                                                                        
Practice Leader in Labor Relations and Workplace Systems

Rocco Scanza is currently the Deputy Director of Cornell University's Institute on Conflict Resolution, headquartered in Ithaca, New York. He provides executive education in a certificate program, and also manages several ADR rosters.

For 16 years, Rocco was employed by the American Arbitration Association, serving as a Case Administrator, as a training consultant in their Department of Education of Training, as Regional Vice President of their Los Angeles Region, and most recently as National Vice President for Neutral's Relations. While the National Vice President for the AAA, his role included recruiting high-profile neutrals, establishing guidelines for neutral performance, creating national specialty panels, and authoring the mandatory arbitrator training program.

He is an Adjunct Faculty Member in the School of Law at Loyola University and lectures extensively in ADR. Rocco practiced employment law for several years with the law firm of Finkle, Davenport and Barsamian in Fresno, California.

Rocco received a B.A. in Communications from Queens College in New York City and a J.D. from Loyola Law School in Los Angeles.

Samuel Carmen
Practice Leader in Labor Relations and Interest Based Negotiations

Sam Carmen is recognized as a national expert in public sector labor relations and public educational policy. Formerly the Executive Director of the Milwaukee Teacher's Education Association, in Milwaukee, Wisconsin, Sam was responsible for the strategic planning process, legislative efforts, staff oversight, and resource allocation for this major public sector labor organization. For several years Sam was also the union Chief Negotiator, responsible for day to day employee relations, collective bargaining, contract administration, redesign efforts, salary strategy, fringe benefits, and arbitration.


Prior to his current responsibilities, Sam was employed in a variety of roles with public sector labor unions in New York State. He has significant experience in collective bargaining, grievance administration, labor law, and labor arbitration.

He is on the Board of Directors of Wisconsin Citizens Action and the non-profit Milwaukee Teacher Education Center. He has lectured extensively with the American Arbitration Association and the Association of Labor Relations Agencies.

Sam received his undergraduate degree in labor and industrial relations from Cornell University in Ithaca, New York, and has completed graduate studies in public policy planning from the University of Wisconsin and at the Kellogg Management Institute at Northwestern University in Evanston, Illinois.
